About Divorce in New York City
In order to be granted a divorce, a New York City couple must meet certain residency requirements. New York law stipulates that in order to be granted a divorce, a couple must meet at least one of the following requirements:
- The couple must have been married in the state of New York as husband and wife
- At least one spouse has been a New York resident for at least one continuous year before filing for divorce
- The couple resided in New York state as husband and wife
- The grounds for divorce occurred in New York
Because New York is NOT a "no fault" state, a couple must have reasonable grounds for filing for a divorce. This means that a couple will not be granted a divorce for reasons like "loss of interest" or "irreconcilable differences." Acceptable grounds for divorce in New York include:
- Cruel, abusive, or inhumane treatment
- Adultery
- One spouse abandoned the other for at least one year
- One spouse has been imprisoned for at least three years
- The couple lived separately for at least one year under a separation agreement
- The couple lived separately for at least one year under a court judgment
If a couple does not have legal grounds for divorce they must live separately for a period of one year under a court-issued separation agreement. After one year has passed, if the couple still wants to proceed with the divorce process, then the court will grant them a divorce. A couple does not need to have legal grounds to file a separation agreement.
