Child Custody

One of the most hotly debated issues in any divorce is child custody.  Each parent has their own opinions and desires with regards to the custody arrangement of their child (or children).  When parents cannot mutually reach a child custody agreement, it is in their best interest to retain separate legal representation. Conflicting opinions make it difficult to settle child custody issues in a quick and cost efficient manner.  An experienced divorce lawyer can protect his or her clients’ best interest, and help them reach a custody arrangement that meets their satisfaction.

Child custody determines who will be responsible for the overall well-being of a child. During a divorce, parents have the opportunity to come to a custody arrangement on their own terms. However, when the parties cannot mutually agree upon a custody agreement, the courts will intervene. The judge will always make a child custody ruling based on what is in the best interest of the child.  There are a number of factors that will be taken into consideration before a custody decision is made, such as:

  • The physical and mental health of each parent
  • Each parent’s financial resources
  • Each parent’s ability to provide for the child
  • The quality of care each parent is able to provide
  • The current relationship the child has with each parent
  • The child’s preference (if above a certain age)
  • The child’s current lifestyle and living arrangement
  • The age of the child
  • If the child will be separated from his or her siblings

After a judge has considered these factors, he or she will make a ruling as to which parent will be awarded physical and legal custody of the child. Physical and legal custody can be awarded to both parents, or they may be granted to only one parent.  Physical custody refers to which parent the child will reside with on a daily basis. The parent(s) with legal custody has the authority to make all legal decisions on behalf of the child.  It is not only married parents that can seek child custody.
