Long Island Divorce
In order to be granted a divorce, a Long Island couple must meet certain residency requirements. New York law stipulates that in order to be granted a divorce, a couple must meet at least one of the following requirements:
- The couple must have been married in the state of New York as husband and wife
- At least one spouse has been a New York resident for at least one continuous year before filing for divorce
- The couple resided in New York state as husband and wife
- The grounds for divorce occurred in New York
Until recently, New York did not allow for a "no-fault" divorce on the basis of irreconcilable differences or mutual consent. In August of 2010, however, Governor Paterson approved a No-Fault Divorce bill. Prior to this, acceptable grounds for divorce in Long Island included:
- Cruel, abusive, or inhumane treatment
- Adultery
- One spouse abandoned the other for at least one year
- One spouse has been imprisoned for at least three years
- The couple lived separately for at least one year under a separation agreement
- The couple lived separately for at least one year under a court judgment
The final option now allowable is a relationship between a husband and wife that has been irretrievably broken for at least 6 months. All that is required for this basis for divorce is that one of the spouses testify that this is so.
